  • i got notice from customs

    hello bros and sisters.

    i recently bought an SMOK X priv from AliExpress and today i got notice from Customs here are what they wrote in notice.



    CALL-CUM-SHOW-CAUSE-NOTICE


    1. wheres shri imran ali resident of --my address-- (here in after referred to as "the importer")
    has imported E-CIGARETTE (here in after referred to as "the said goods" having assessable value as Rs. 1046/- vide tracking no. rfgt7377373 and hhhr4444 The said goods were duly assessed by the
    customs authorities on the basis of the declaration available on the parcel / packet and were seized as import of the said goods by post is prohibited / restricted.

    2. whereas the said goods are tobacco and tobacco products / e-liquids having nicotene content / e-cigarette used for smoking e-liquid, import of which is prohibited under the Drugs and Cosmetics Act, 1940.

    3. whereas the said goods are liable for absolute confiscation under the provisions of section 111(d) of the Customs Act, 1962 and the importer is liable for iposition of penalty under Section 112(a) of the Customs Act, 1962.


    4. now therefore, Shri Imran Ali resident of --my address-- is hereby required to show cause to the Superintendent / Appraising Officer of Customs, Postal Appraising Section having his / her office at --their address-- within 10 days of receipt of this notice as to why:


    (a) E-CIGARETTE having declared value / fair value as Rs. 1046 imported by Shri Imran Ali should not be confiscated under Section 111(d) of the Customs Act, 1962.

    (b) Penalty should not be imposed upon the importer under Section 112(a) of the Customs Act, 1962.


    so what should i do now? please reply A.S.A.P

    I have read the Customs Act 1962 and have also seen Prohibited Items as well as Restricted Items outlined by customs. Nowhere it is mentioned that ECigs are prohibited. Other guys have visited the customs office and asked them that nowhere it is mentioned in the act or on the lists. The canned reply customs gave is that they received orders from the government to ban these items.

    You can't make up law until it is passed and added to the Act or until the items are added to the Prohibited or Restricted items list.

    Simple thing bro, file a RTI. It is easy to file one online. File a RTI and ask where the fuck is it mentioned that Ecigs are prohibited or restricted? Customs officer will have to release the package within 30 days. Many have got their packages released.

    They are outlining the Drugs and Cosmetics Act 1940. In ullu ke patho ko puchho, how does an electronic device fall in that category?
    Then they are outlining the Customs Act 1962. In kutto ko puchho, where are Ecigs mentioned in the act?

        I'm not sure how will that pan out since it is in your name and your CC used to order items. If you ordered in your friend/brother/sis name and used their CC, then they might be answerable.

            Yes, you can say that. But in that case, customs may confiscate your package at the least.

              I had the same issue. Ordered a Smoke V8 and an Eleaf 20W mod. Both were detained by customs. Visited their office and the officer told me the reason was e-liquid in the packages. I asked him to verify the contents in my presence, as I knew it had no eliquid. He didn't agree and after a while outright said no to all my requests.

              Yesterday after going through the links in your answer, I filed an RTI on the issue. Let's see what happens.
